Let’s Go Bird End User License Agreement

LET’S GO BIRD End User License Agreement Effective Date: March 5, 2026 Version 1.0 This End User License Agreement (“Agreement”) is between you and Let’s Go Bird LLC, a Maine limited liability company (formation pending) (“Let’s Go Bird,” “we,” “our,” or “us”). 1. Parties and Scope This Agreement governs your use of the Let’s Go Bird mobile and web application including gamified birding features, community features, audio recording tools, photo submission tools, and future social features. 2. License Grant Let’s Go Bird grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial birding and nature observation activities. 3. User Submissions By submitting photos or audio recordings you assign ownership of those submissions to Let’s Go Bird as described in the full agreement. 4. Location Data The App may collect location data associated with sightings for biodiversity mapping, gamification features, conservation research, and machine learning model development. 5. Research Access Approved researchers, conservation organizations, and government agencies may request access to Let’s Go Bird datasets and models. 6. Gamification and Social Features The App may include checklists, badges, leaderboards, and future social features. 7. Prohibited Conduct You may not submit fabricated evidence, AI-generated bird media, attempt unauthorized access, or circumvent species protection mechanisms. 8. Intellectual Property All App software, branding, and content excluding user submissions belong to Let’s Go Bird LLC. 9. Privacy Use of the App is also governed by the Let’s Go Bird Privacy Policy. 10. Disclaimers The App is provided “as is.” Species identification relies on probabilistic models and may be incorrect. Wildlife Safety Users are responsible for their own safety and must comply with wildlife protection laws. 11. Limitation of Liability Total liability of Let’s Go Bird shall not exceed $50 USD. 12. Indemnification You agree to indemnify Let’s Go Bird against claims arising from your use of the App or submitted content. 13. Termination Let’s Go Bird may terminate access at any time. 14. Governing Law This Agreement is governed by the laws of the State of Maine. Arbitration takes place in Augusta, Maine. 15. Changes Let’s Go Bird may update this Agreement and continued use constitutes acceptance. ACCEPTANCE BY USING THE LET’S GO BIRD APP YOU AGREE TO THIS AGREEMENT.
